ND Judge Blocks Federal Rule Limiting Natural Gas ‘Venting’

A North Dakota judge has temporarily blocked a new rule from the federal Bureau of Land Management which aims to reduce venting and flaring of natural gas at oil wells. U.S. District Judge Daniel Traynor wrote “At this preliminary stage, the plaintiffs have shown they are likely to succeed on the merits of their claim the 2024 rule is arbitrary and capricious.” North Dakota, Montana, Texas, Wyoming, and Utah filed a challenge to the rule in federal court earlier this year, arguing that it would hinder oil and gas production and that the Bureau of Land Management is overstepping its regulatory authority on non-federal minerals and air pollution.
