Supreme Court of North Dakota declares city of Fargo can’t ban people from selling guns and ammunition from their homes

North Dakota’s Supreme Court declared that the city of Fargo cannot ban people from selling guns and ammunition out of their homes in an opinion published Thursday.

Fargo sued the state over a law that bans zoning ordinances related to guns and ammo. The Legislature passed the law in 2023, but Fargo had an ordinance that banned people from selling guns and ammunition out of their homes. The law voids existing and related ordinances.

The Supreme Court of North Dakota found the law does not violate the North Dakota Constitution, stating the law is a valid exercise of its constitutional authority to create political subdivisions and to define the powers of a home rule city.
