North Dakota House Bill 1239 would protect facilities that mine cryptocurrency from being restricted or prohibited as long as they follow all noise regulations.

It also keeps local governments from placing exclusive restrictions against those types of data centers. Supporters of the bill believe it is a way to further entice businesses to build data centers in North Dakota. Opponents argue it’s a violation of local control and feel noise might not be the only issue.

The bill also exempts miners from needing to have a money transmitter license. State officials say it’s not necessary since they are already exempt.
