North Dakota Republican Lawmakers Propose Fining School, Faculty Allowing Transgender Student Identity

Republican lawmakers in North Dakota are proposing enacting fines on schools that allow students to use the bathroom and pronouns they want and aligns with their gender identity.

The state legislature prohibited transgender students from doing these things in a law last year, but no fines or penalties were included.  Now, Republicans who hold supermajorities in the state legislature want to include fines and possibly criminal penalties for schools, teachers, and administrators who allow students to use their preferred bathroom or pronouns.  Those fines could be up to $2,500 per violation.

The American Civil Liberties Union and multiple health organizations have challenged last year’s law, and the ACLU says they oppose this proposed penalty addition they described as blatantly unconstitutional.

Senate Bill 2104 would further divert authority from schools to the state legislature and lawmakers.   The bill is awaiting advancement in committee this week.
