Burleigh County expects to challenge a recent state permit approval for a major carbon dioxide pipeline set to route a few miles to the north of Bismarck. The County Commission voted unanimously to move forward with the appeal on Wednesday.
The county must file its appeal to the decision in court by Dec. 15. Over $127,000 in legal fees have been spent by Burleigh County. The appeal follows a lawsuit by Emmons County, who failed a challenge against the PSC’s decision over the authority of local ordinances.
Summit Carbon Solutions has proposed the $8 billion project that would capture CO2 emissions from 57 ethanol plants and use the pipeline to take them to western North Dakota for storage underground.
