Judge Rules North Dakota Families Can’t Challenge Law Against Gender-Affirming Care

Three families challenging the ban against gender-affirming care in North Dakota will no longer be able to participate in the case.

District Court Judge Jackson Lofgren ruled that of four initial plaintiffs, only Dr. Luis Casas had standing to challenge the 2023 law that makes it a crime to provide the care to anybody under 18 years old, and exempts those who were already receiving care.  Judge Lofgren ruled that three families with transgender children can’t challenge the law. The law was passed by the legislature signed by Governor Doug Burgum.

Judge Lofgren ruled that Dr. Casas, a pediatric endocrinologist, said his case can proceed due to the effect the law will have on him and his future patients.  The ruling is likely to be appealed by the families.
